Individualized Legal Document Program
for Notices to Landlords

Arizona Tenants Advocates (ATA) announces that it has established a new program to assist tenants in giving notice to their landlords. Up until now, ATA has focused on its Break Lease venture. The letter writing service represents a significant expansion of tenants’ rights in the State of Arizona.

For a nominal annual fee, residential renters throughout Arizona can sit down, face-to-face, with a legal document preparer to formulate individualized notice letters to landlords and their agents. There will be a charge per letter, but not for the amount of time devoted to letter preparation. This is important, as some letters can take several hours to prepare.

The letters can address a wide range of topics. These can include responding to, or giving, notices regarding:

alleged default noncompliances
self-help repair
fire or casualty remedies
improper landlord access to premises
failure to supply essential services
demand for return of deposits
wrongful withholding of deposits
payment of rent or reduced rent
vacating and requesting move-out inspection

and much, much more. Plus, ATA will actually print out the notice letters and prepare the envelope for certified mail delivery, return receipt requested. Alternatively, ATA will contact a process server to arrange hand-delivery.

Many of these prepared notice letters presented by the tenants create a paper trail that can serve as evidence in a court of law. If needed, ATA can refer tenants to a private attorney for case litigation and/or defense.

Presently, tenants can contact some municipalities to receive forms that the tenants fill out themselves. Most times they do not have a clue how to structure their language or deliver the documents. Consequently, more often than not these form notices fail to achieve the intended purpose, leaving renters vulnerable to prosecution by landlord attorneys. ATA-produced notice letters will help level the playing field. They display a professional presence.

The fee structure is as follows: ATA annual membership: $45.00; 1st letter: $100.00; 2nd letter: $75.00; and each letter thereafter: $50.00. Tenants can use the service any number of times during the annual membership period, and the document pricing will count from the first series of letters, i.e. it will not reset back to $100.00.

The Break Lease program shall continue as presently operated, on a sliding scale pricing policy.

ATA operates as a tenants’ union, assisting residential tenants from throughout Arizona, including all municipalities, under the Arizona Residential Landlord & Tenant Act. General guidance is available over the phone for no charge. ATA commits to providing top quality, effective services at the most reasonable prices. Our counselors have had years of experience in tenant advocacy. Most of the available letters for ATA’s new program have been refined since the early 1990s.
